Representative Matters

  • Representing insurer in coverage action seeking recoveries for over 1,000 lawsuits arising from exposure to ethylene oxide.
  • Advising cedants and reinsurers on a wide variety of reinsurance coverage and contract issues arising under treaties, facultative certificates, and large loss portfolio transfer agreements, including collateral, warranties, and subject business.
  • Regularly providing coverage advice and representation to direct insurers relating to all manner of claims under a variety of policies, including commercial general liability, excess, professional liability.
  • Represented ceding companies in a “lost policy” dispute and an arbitration seeking coverage under reinsurance treaties for asbestos claims.
  • Represented surety company in an arbitration involving construction bonds written by a managing general agent that became insolvent.
  • Represented reinsurer in dispute involving cession of lead paint claims involving complex occurrence and allocation issues and bad faith.
  • Represented ceding companies and reinsurers in over 30 arbitrations involving underwriting issues, allocation and aggregation of losses, coverage under quota share, excess of loss, catastrophe, and facultative contracts, financial solvency, commutation, bad faith, fraud and rescission claims, pre-answer security and letters of credit, audit rights, and notice issues.
  • Represented clients in coverage disputes under Bermuda forms.
  • Advised start-up company on reinsurance contract wording.
