MCWG Reinsurance Mediation Group
Mound Cotton Wollan & Greengrass announced the formation of its Reinsurance Mediation Group in 2000. To complement the group, the firm published a 5-page Rules and Procedure Manual, which applies to all mediations they conduct and is designed to insure the most expeditious determination of parties' disputes.
A copy of the MCWG Reinsurance Mediation Rules and Procedure Manual can be obtained by clicking here. While there has been much in the way of criticism of the arbitration process, the firm continues to believe that in most instances private, confidential arbitration is preferable to drawn out and expensive litigation in the courts. Nonetheless, there are often situations where the process of arbitration itself has become too costly and companies with disputes over reinsurance issues find themselves reluctant to resort to its use. In some instances, consideration of the amount in controversy, the nature of the issues, or the relationships between the parties militates in favor of a less confrontational mediation process.
