RULES OF PROFESSIONAL CONDUCT

This program will address some recent developments in the area of professional responsibility.  Topics to be discussed include: what constitutes sufficient supervision by a senior lawyer; how can a junior lawyer determine what constitutes a reasonable resolution of an arguable question of professional duty; what are the implications for lawyers of the new whistle-blower rules in the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010; and under what circumstances is a junior lawyer protected from retaliatory firing under Wieder v. Scala and its progeny. [The faculty will also discuss the assertion of privilege on behalf of a regulated entity, and whether a law enforcement agency is likely to consider a company’s assertion of privilege as a factor when deciding to recommend an enforcement proceeding.]
